TSS 482 Visa – English language Requirements

Meeting the English language proficiency requirement is a critical step in the majority of employer-sponsored visa applications. Whether you are applying under the legacy TSS 482 visa program (lodged before 7 December 2024) or the new Skills in Demand (SID) 482 visa, understanding the score thresholds, valid tests, and exemption categories is essential.

Important Note: The new SID visa (post-7 December 2024) has adopted the Medium-Term stream English requirements as its standard. This means a slightly higher bar than the old Short-Term stream.

Overview: English Requirements by Stream

1. English Requirements for the New SID 482 Visa

From 7 December 2024, the Skills in Demand (SID) visa applies a uniform English language standard across its streams (Specialist Skills, Core Skills, and Essential Skills).

The Requirement:
The English requirements of the former TSS Medium-Term stream now apply to all SID visa applicants. This means:

  • IELTS: An overall score of at least 5.0, with a minimum score of 5.0 in each of the four components (Listening, Reading, Writing, Speaking).
  • This applies to the Core Skills stream (the main replacement for the TSS visa) and the Specialist Skills stream.

Key Rules for All English Tests

Regardless of which stream you apply under, the following universal rules apply to English language evidence:

  1. One Sitting: You must achieve the required scores in a single attempt at the test. The Department does not accept combining scores from multiple tests.
  2. Three-Year Validity: The test must have been undertaken within the 3 years immediately before the day you lodge your visa application. If your test is older than 3 years, it will not be accepted.
  3. Evidence: You must provide a copy of your test result (TRF) with your application.

Exemptions from English Language Proficiency

You do not need to demonstrate English language proficiency (and can be exempt from providing test scores) if you fall into one of the following categories:

Category A: Passport Holder (Five-Country Exemption)

You are exempt if you hold a valid passport issued by:

  • Canada
  • New Zealand
  • The Republic of Ireland
  • The United Kingdom
  • The United States of America

Note: You must be a citizen of that country, not just a resident.

Category B: Five Years of English-Language Study

You are exempt if you have completed at least 5 years of full-time study in one or more institutions where all instruction was conducted in English.

  • The study must be at least at the secondary school level or higher.
  • You will need to provide evidence, including:
    • Name and location of the institution(s).
    • Level of qualification(s) achieved.
    • Official academic transcripts.
    • A statement confirming the number of contact hours per week and the language of instruction.

Category C: Diplomatic or Consular Missions

You are exempt if your nominated occupation in Australia will be performed at:

  • A diplomatic or consular mission of another country.
  • An Office of the Authorities of Taiwan.

Category D: Registration, Licence or Membership (Paired with Higher Score)

You are exempt if all of the following apply:

  • Your nominated occupation requires you to hold a specific licence, registration, or professional membership.
  • You were granted that licence, registration, or membership.
  • To be granted that licence/registration, you had to prove an English proficiency level that is equal to or higher than the standard visa requirement.

(Note: This is a complex area. You must provide evidence from the licensing body confirming the English standard required for the licence.)

Category E: High Income Earners (Overseas Business Employees)

You are exempt if you are:

  • An employee of an overseas business (not an Australian business).
  • The overseas business (or an associated entity) has nominated you to work in Australia.
  • You will receive guaranteed annual earnings of at least AUD $96,400 (Note: This threshold is subject to indexation and was the figure for the TSS program; check current SID requirements for updated figures).

TSS 482 Visa to Permanent Residency: English at the PR Stage

It is crucial to understand that the English requirement increases when you apply for Permanent Residency.

  • For the TSS visa (temporary stage): You need ‘Vocational English’ (IELTS 5.0 / PTE 36).
  • For the Subclass 186 visa (PR stage): You need ‘Competent English’ .
    • IELTS: 6.0 in each component.
    • PTE: 50 in each component.
    • TOEFL iBT: Listening: 12, Reading: 13, Writing: 21, Speaking: 18.

If you are planning to transition to PR after 2 years on your TSS visa, you should begin preparing for the higher English standard required at the permanent stage.
